Use Conditions

1.1. Website Access

Access to the Website is free, except for the cost of the telecommunications network connection provided by the access provider contracted by the User.

1.2. Member Registration

To view some of the Website's content and to purchase the products offered therein, User registration will be necessary. However, browsing certain sections of this Website is not conditioned on prior User registration.

The data entered by the User during the registration process must be accurate, current, and truthful. The registered User will acquire the status of Member (hereinafter, "the Member") and will be responsible at all times for the safekeeping of their password, consequently assuming any damages that may arise from its improper use, as well as its transfer, disclosure, or loss. For these purposes, access to restricted areas and/or the use of services and content carried out under the password of a registered Member will be considered to have been carried out by said registered Member, who will be liable in all cases for such access and use.

In the event that personal data of third parties is provided during registration, the User/Member declares, by accepting these general conditions, that they have the consent of the third party for the transfer of their data.

1.3. My Account

Once the Member is correctly registered on the website, they can access "My Account" at any time. Through "My Account", the Member can modify their personal data as well as data related to order shipping, and check if they have pending deliveries.

In the "My Account" section, the Member can view any gift vouchers they may have, see past orders, and cancel the account at any time by stating a reason for cancellation.

1.4. Website Usage Rules

The User/Member agrees to use the Website and all its content and services in accordance with the law, morality, public order, and these Legal Conditions. By way of example, and in no case limiting or excluding, the User/Member undertakes to:

Not introduce or disseminate content or propaganda that is racist, xenophobic, pornographic, that advocates terrorism, or that violates human rights.

Not introduce or disseminate data programs (viruses and harmful software) into the network that are likely to cause damage to the computer systems of the access provider, its providers, or other Internet Users.

Not disseminate, transmit, or make available to third parties any type of information, element, or content that infringes upon fundamental rights and public freedoms recognized constitutionally and in international treaties.

Not disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes illegal or unfair advertising.

Not transmit unsolicited or unauthorized advertising, promotional material, "junk mail," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as commercial spaces) that have been exclusively designed for this purpose.

Not introduce or disseminate any false, ambiguous, or inaccurate information and content in a way that misleads the recipients of the information.

Not impersonate other Users by using their registration keys to the different services and/or contents of the Website.

Not disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes a violation of intellectual and industrial property rights, patents, trademarks, or copyrights belonging to the Website owners or third parties.

Not disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes a violation of the secrecy of communications and personal data legislation.

In the event that the JOSELITO website User/Member provides third-party personal data through a "billing address" different from a "shipping address," they expressly state that they have the consent of this third party for the transfer of their data to JOSELITO solely for the purpose of sending them the information that the member believes may be of interest to this third party, with JOSELITO STORE not being responsible for sending such information to the third party in question.

The User/Member undertakes to indemnify JOSELITO against any possible claim, fine, penalty, or sanction that it may be obliged to bear as a consequence of the User/Member's non-compliance with any of the aforementioned usage rules, with JOSELITO also reserving the right to claim the corresponding compensation for damages.

1.5. Exclusion of Liability

JOSELITO is not responsible for damages caused to the software and computer equipment of Users/Members or third parties during the use of the services offered on the Website, nor for damages or losses of any kind caused to the User/Member that arise from failures or disconnections in the telecommunications networks that cause the suspension, cancellation, or interruption of the Website service during its provision or beforehand.

1.6. Intellectual and Industrial Property

All the contents of the Website, understood as merely illustrative, including texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source codes, are the intellectual property of JOSELITO or third parties, without any of the exploitation rights recognized by current intellectual property regulations regarding them being understood as transferred to the User.

The brands, trade names, or distinctive signs are the property of JOSELITO or third parties, without access to the Website being understood to confer any right over them.

2. Applicable Legislation and Competent Jurisdiction

These General Conditions are governed by Spanish law. The parties agree to submit to the Courts and Tribunals of Salamanca, expressly waiving their own jurisdiction if they had one.
